- Primero. Modificar la Sentencia proferida el 26 de febrero de 2003 por la Sala Civil del Tribunal Superior de Bogotá y revocar la Sentencia proferida el 14 de enero de 2003 por el Juzgado Veintidós Civil del Circuito de Bogotá.
- Segundo. Tutelar el derecho al debido proceso de los accionantes Elsa Rubiela Vega Rodríguez y José Guillermo Gómez Mancera.
- Tercero. Ordenar a la Contraloría de Cundinamarca anular la actuación cumplida, en el proceso de responsabilidad fiscal promovido contra los actores, a partir de la resolución 791 proferida el 11 de septiembre de 2002, inclusive, y volver a emitir ese acto administrativo teniendo en cuenta lo dispuesto por esta Corporación en la Sentencia C-619 del 8 de agosto de 2002.
- Cuarto. DÉSE cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
