  1. Primero. REVOCAR las sentencias proferidas por el Juzgado
  2. Cuarto. Laboral del Circuito de Cali y el Tribunal Superior del Distrito Judicial de Santiago de Cali. En consecuencia, CONCEDER la tutela por violación del derecho de petición en conexidad con el derecho a la seguridad social.
  3. Segundo. Para el cumplimiento de la tutela que se concede, se ordena que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta demanda, la Corporación Autónoma Regional del Valle del Cauca, deje sin efectos las resoluciones 005 de febrero 7 de 2003 y 068 de febrero 18 de 2003 y en el término de cuatro (4) meses, contados a partir de la notificación de la presente sentencia, de conformidad con la parte motiva de esta sentencia, resuelva de fondo la petición sobre reconocimiento de la pensión del accionante.
  4. Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
