- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Penal Municipal de Monteria, el 23 de febrero de 2004.
- Segundo. CONCEDER la accion de tutela impetrada por la senora Francisca Hoyos Ruiz en su calidad de agente oficiosa de su conyuge Alfonso Enrique Estrada Gonzalez.
- Tercero. ORDENAR al representante legal de la A.R.S. Comparta de la ciudad de Monteria, o quien hagas sus veces, autorizar la intervencion quirurgica requerida por el senor Alfonso Enrique Estrada Gonzalez, asi como el tratamiento medico que necesite para su enfermedad, dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia.
- Librense por Secretaria, las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
