- PRIMERO. REVOCAR la sentencia dictada por el Juzgado
- Quinto. Civil Municipal de Barranquilla, del 4 de diciembre de 2003, que nego la tutela de los derechos fundamentales de los ciudadanos Lizbeth Sarmiento Picalua y Jose Gallego Garcia y en su lugar CONCEDER la tutela de sus derechos fundamentales a la salud, a la vida y a la integridad personal.
- SEGUNDO. ORDENAR a la entidad demandada que, en el termino de 48 horas proceda a autorizar la practica del examen de carga viral ordenado a los actores. La realizacion del examen no podra efectuarse mas alla de un termino razonable conforme a los turnos de atencion de la respectiva E.P.S. y, en ningun caso, en un plazo superior a un mes. Debera, para tal efecto, informar a los jueces de instancia y a los demandantes, la fecha cierta de realizacion del examen.
- TERCERO. Para los efectos del articulo 36 del decreto 2591 de 1991, el juzgado de origen hara las notificaciones y tomara las medidas conducentes para el cumplimiento de esta sentencia.
