Primero. REVOCAR, por las razones expuestas en la parte considerativa del presente fallo, la sentencia proferida por el Juzgado Promiscuo Municipal de Granada, Antioquia, el día 23 de noviembre de 1999.
Segundo. CONCEDER la tutela para la protección del derecho de petición del ciudadano Gildardo de Jesús Tamayo Giraldo. En consecuencia, ORDENAR a la Caja Nacional de Previsión Social "Cajanal", que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación del presente fallo, responda la solicitud de reconocimiento y pago de pensión de gracia que le ha formulado el demandante.
Tercero. Por Secretaría, líbrese la comunicación prevista por el artículo 36 del Decreto 2591 de 1991.
