- PRIMERO. Revocar el fallo proferido por la Sala de Casacion Penal de la Corte Suprema de Justicia, el 15 de agosto de 1995, en el proceso de tutela adelantado por Jose Manuel Arco Garces contra la Jueza Primera Penal Municipal de Cartagena.
- SEGUNDO. Conceder la tutela del derecho al debido proceso invocado por el demandante y, en consecuencia, ordenar a la Jueza Primera Penal Municipal de Cartagena, o a la autoridad judicial que corresponda, que en el termino de quince (15) dias, contados a partir de la notificacion de este fallo proceda a cerrar las investigaciones que adelanta contra Jose Manuel de Arco Garces, en las cuales se encuentran vencidos los terminos, y continue la tramitacion de los procesos, observando en forma estricta los terminos previstos para las restantes actuaciones judiciales.
- TERCERO. Confirmar el numeral
- tercero. de la sentencia proferida por el Tribunal Superior de Cartagena, Sala Penal en cuanto al envio de copias al Consejo Seccional de la Judicatura de Bolivar para que, si lo estima pertinente, inicie las investigaciones disciplinarias a que haya lugar por la mora en que incurrio la funcionaria en la tramitacion de los procesos relacionados en esta accion.
- CUARTO. Comunicar la presente providencia al Tribunal Superior del Distrito Judicial de Cartagena, para los efectos del articulo 36 del Decreto 2591 de 1991.
