- Primero. Revocar la sentencia proferida el 6 de julio de 2001 por el Juzgado Penal del Circuito, y en su lugar tutelar el derecho de peticion de Lucia Garcia Garzon y las demas personas a nombre de quien esta actua, dentro del proceso de la accion de tutela interpuesta por ella en contra del Departamento Administrativo de Fomento Ecoturistico.
- Segundo. Ordenar al Departamento Administrativo de Fomento Ecoturistico que, si aun no lo ha hecho, responda de fondo la peticion presentada por la accionante, en el termino de 48 horas contadas a partir de la notificacion de este fallo. En caso de que la peticion no pueda ser absuelta cabalmente por dicha dependencia, esta debera remitirla a la autoridad encargada de hacerlo y tomar las medidas necesarias para que el derecho de peticion sea efectivamente respetado.
- Tercero. Librar, por medio de la Secretaria General, las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991. El fallo se comunicara tambien a la Defensoria del Pueblo.
- Cuarto. Remitir, para lo de su competencia, copia de la sentencia y del expediente a la Procuraduria General de la Nacion y a la Contraloria General de la Republica.
