- Primero. CONFIRMAR, por las razones expuestas en esta providencia, el fallo de segunda instancia, dictado en este asunto el 26 de febrero de 2002 por el Juzgado Trece Civil del Circuito de Medellín, mediante el cual revocó la sentencia de primera instancia adoptada por el Juzgado Trece Civil Municipal de la misma ciudad el 19 de diciembre de 2001, en virtud de la acción de tutela promovida por MARIO OSPINA RAMÍREZ contra Coomeva EPS S. A.
- Segundo. ORDENAR al señor Juez Trece Civil Municipal de Medellín que, una vez regrese el expediente a su Despacho, compulse copias de la actuación para que adelante la averiguación disciplinaria a que haya lugar por la razón señalada en la parte considerativa de esta providencia.
- Tercero. ORDENAR que por la Secretaría General se dé cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
