- Primero. REVOCAR, por las razones expuestas en la parte considerativa del presente fallo, la Sentencia proferida por el Juzgado
- Tercero. Civil del Circuito de Ibague, el 1deg de marzo de 1999.
- Segundo. CONCEDER la tutela para la proteccion de los derechos a la familia y a la igualdad de la menor Malka Negret Roldan. En consecuencia, ordenar a la Caja de Compensacion de Fenalco del Tolima "Comfenalco del Tolima", que a partir de la notificacion del presente fallo, reconozca y pague el subsidio familiar en dinero que le corresponde por su condicion de hijastra de la senora Claudia Osorio Gomez.
- Tercero. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
