- Primero. REVOCAR la sentencia proferida el 2 de diciembre de 2003 por el Juzgado
- Segundo. Civil Municipal de Bello, Antioquia. En consecuencia, CONCEDER la tutela de los derechos fundamentales invocados por la accionante.
- Segundo. ORDENAR a COOMEVA E.P.S. que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, proceda a reiniciar la atención en salud que requiere la señora María Janeth Valencia Villa y su hijo recién nacido.
- Tercero. ADVERTIR a Coomeva E.P.S. que está facultado para repetir contra el Municipio de Bello, por los gastos en los que incurra por la atención en salud de la accionante y de su hijo. Esto sin perjuicio de la continuación de los trámites administrativos y judiciales tendientes a obtener el pago de los aportes al sistema de seguridad social en salud por parte del Municipio demandado.
- Cuarto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
