- Primero. Revocar el fallo proferido por el Juzgado 29 Penal Municipal de la ciudad de Bogotá, del 28 de diciembre de 2000, mediante el que se denegó el amparo solicitado por el actor de sus derechos a la salud y a la vida.
- Segundo. Tutelar los derechos a la vida y la salud de Carlos Humberto Ruiz Salamanca y, en consecuencia, ordenar a la E.P.S Salud Colpatria que una vez realizada la notificación de esta providencia, le haga entrega de los medicamentos formulados por el médico tratante.
- Tercero. Declarar que la E.P.S. Salud Colpatria tiene derecho a repetir contra el Ministerio de Salud - Fondo de Solidaridad y Garantía, hasta el monto de los costos en que haya incurrido y que corresponden al Estado, por concepto de cuota de recuperación.
- Cuarto. Librar, por medio de la Secretaría General, las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
