- Primero. CONFIRMAR por las razones expuestas en esta providencia el fallo proferido el 15 de noviembre de 2000 por el Juzgado Cuarenta y Siete Penal del Circuito de Bogota que confirmo el fallo del Juzgado Treinta y Cuatro Penal Municipal de Bogota del 11 de octubre de 2000, en el que se rechazo por improcedente la tutela invocada, salvo en lo referente a los demandantes Rosalva Rojas Torres y Belisario Latorre Cante.
- Segundo. ORDENAR al juez de primera instancia tramitar, asegurando la conformacion del contradictorio necesario, la pretension de Rosalva Rojas Torres y Belisario Latorre Cante, sin necesidad de presentacion de nueva demanda por parte de estos, ni sometimiento a reparto.
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
