- Primero. Revocar el fallo proferido por la Sala de Casacion Civil de la Corte Suprema de Justicia el 6 de diciembre de 2001, dentro del proceso de tutela iniciado por Jaime Hernan Ardila en representacion de Carlos Mario Hincapie Molina y Beatriz Helena Hincapie Molina contra el Juzgado 2 Civil del Circuito de Bogota, y en su lugar conceder la proteccion del derecho al debido proceso.
- Segundo. Dejar sin valor y efecto toda la actuacion surtida a partir del auto de 21 de septiembre de 1998, inclusive, proferido por el Juez
- Segundo. Civil del Circuito de Bogota en el proceso ejecutivo con titulo hipotecario del Banco de Bogota contra Carlos Mario Hincapie Molina y Beatriz Helena Hincapie Molina, referencia (Ndeg 6058).
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
