  1. Primero. REVOCAR la sentencia proferida por el Juzgado Cuarenta Civil del Circuito de Bogotá. En consecuencia, conceder el tutela solicitada por el señor RAFAEL EDUARDO MELO PEÑA.
  2. Segundo. INAPLICAR de conformidad con el artículo 4 de la Constitución Política y para este caso específico el parágrafo del artículo 12 de la resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7 del Acuerdo 08 de 1994, del Consejo Nacional de Seguridad Social en Salud.
  3. Tercero. ORDENAR a la E.P.S. SANITAS, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a ordenar el efectivo suministro e implantación de los audífonos recetados por el médico tratante del señor EDUARDO MELO PEÑA.
  4. Cuarto. AUTORIZAR a la E.P.S. SANITAS a repetir contra el FOSYGA, por el recobro de los dineros invertidos en el suministro de los audífonos mencionados.
  5. Quinto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
