El actor comenta que debido a la presión de los grupos paramilitares se vio obligado a suscribir contrato de compra venta de un predio de su propiedad con el señor Salvatore Mancuso, solicitó al INCODER registrar dicho predio en el Registro Único de Predios y Territorios Abandonados sinembargo la Oficina de Registro de Instrumentos Públicos de Turbo, no realizó la inscripción por no existir folio de matricula inmobiliaria del bien.
La Sala se pronuncia sobre el principio de subsidiariedad y la procedencia de la acción de tutela, se concluye que los actores no se encuentran frente a la inminencia de un perjuicio irremediable y que existen otros mecanismos defensa ante los cuales puede recurrir para la protección de sus derechos, por lo tanto se decide declarar improcedente la presente acción.
