Primero. ORDENAR, en el caso concreto, con fundamento en el art. 4 de la Constitución la inaplicación del numeral 4-1 del art. 3 de la Resolución No. 20974 de 1989, expedida por el Ministerio de Educación Nacional.
Segundo. REVOCAR el fallo proferido por el Juzgado
Quinto. Laboral del Circuito de Cali, el día 4 de noviembre de 1997, por medio del cual se negó la tutela solicitada y, en su lugar conceder el amparo impetrado por la demandante, por violación a sus derechos fundamentales a la igualdad y al trabajo.
Tercero. ORDENAR a la Gobernación del Valle del Cauca que en el término de 48 horas contados a partir de la notificación de la presente providencia, proceda a nombrar a la señora María Teresa Moreno Murillo en el cargo para el cual concursó. En cuanto a la persona desplazada, téngase en cuenta su nombre para futuros nombramientos según el puesto que le corresponda en la lista de elegibles.
Cuarto. Líbrese por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
