- PRIMERO. Declarar inexequible el artículo 40, literal b , a excepción del parágrafo, de la Ley 48 de 1993.
- SEGUNDO. Disponer que los efectos de la presente sentencia se producirán a partir del momento de la notificación de la misma. En consecuencia, los bachilleres que hayan culminado el servicio militar antes de ese momento y los que aún se hallen prestándolo, tienen derecho a recibir el beneficio previsto en dicha disposición. Por el contrario, los bachilleres que al momento de la notificación de la presente providencia no hayan comenzado la prestación del servicio militar, no serán beneficiarios de la prerrogativa prevista en la norma objeto de la presente declaratoria de inexequibilidad.
