- Primero. CONFIRMAR la sentencia del Consejo de Estado proferida el 5 de diciembre de 2002 en la tutela de la referencia.
- Segundo. El Tribunal Administrativo de Cundinamarca, procedera dentro del termino de cuarenta y ocho (48) horas a devolver la totalidad del expediente # 40.376 que remitio la Seccion Segunda Subseccion D", es decir, el expediente original del juicio contencioso de la senora Maria Hilda Noriega Jordan, que habia sido entregado al juez de tutela "con caracter devolutivo", haciendose las desanotaciones correspondientes.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
