- Primero. CONFIRMAR la sentencia proferida por el Juzgado 4 Civil del Circuito de Bucaramanga (Santander), el 19 de diciembre de 1996, que a su vez confirmó la dictada por el Juzgado
- Octavo. Civil Municipal de la misma ciudad, en el sentido de negar la acción de tutela iniciada en contra de la CLINICA MATERNO INFANTIL SAN LUIS S.A., por los padres del menor JOSE HILARIO SARMIENTO JURADO.
- Segundo. ADVERTIR que de cumplirse los requisitos legales propios del régimen subsidiado, el menor JOSE HILARIO SARMIENTO JURADO, deberá recibir la atención médica que su estado de salud requiere, en una entidad estatal o una privada que tenga contrato con el Estado, de acuerdo con lo expuesto en la parte motiva de la presente providencia.
- Tercero. LIBRAR por Secretaría las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
