- Revocar la sentencia del Juzgado
- Cuarto. Civil del Circuito de Bogotá, de fecha 16 de octubre de 2003, en la acción de tutela presentada por Zoila Inés Peña de Mendivelso contra Salud Total S.A. EPS. En consecuencia, se concede la tutela pedida con el fin de proteger el derecho a la salud, que en este caso incluye los derechos al diagnóstico y a la continuidad en la prestación integral del servicio médico de la actora.
- Para tal efecto, dentro de las cuarenta y ocho horas (48) siguientes a la notificación de esta sentencia, la EPS, si aún no lo ha hecho, autorizará y facilitará la realización del examen que le fue ordenado por el médico tratante a la señora Peña de Mendivelso, a través de la institución de salud correspondiente.
- La entidad podrá repetir contra el Fosyga los gastos en que hubiere incurrido en el cumplimiento de esta tutela, pago que deberá verificarse en el término de seis meses contados a partir de la respectiva solicitud.
- Por Secretaría General líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
