- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. REVOCAR por las razones expuestas, la sentencia proferida por la Sala Plena de lo Contencioso Administrativo del H. Consejo de Estado, el día 10 de noviembre de 1993, y en su lugar CONCEDER a la señora ROSA ESTHER GONZALEZ RODRIGUEZ la tutela de su derecho a obtener las copias de su Historia Clínica a partir del 31 de octubre de 1991, ante el Instituto de los Seguros Sociales de la ciudad de Barranquilla.
- SEGUNDO. ORDENAR al Director del Instituto de los Seguros Sociales de la ciudad de Barranquilla, que expida las copias de los documentos solicitados por la señora ROSA ESTHER GONZALEZ RODRIGUEZ, en el término de cuarenta y ocho (48) horas, contado a partir de la notificación de esta providencia, si para la fecha de esta última no ha sido resuelta la solicitud.
- TERCERO. LIBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
