- Primero. REVOCAR la sentencia de fecha 10 de julio de 2003, proferida por el Juzgado
- Tercero. Civil del Circuito de Pereira (Risaralda) y en su lugar conceder el amparo de los derechos a la salud y a la vida en condiciones dignas del señor Luis Eduardo Mejía Gómez, y en consecuencia se ordena a CAJANAL EPS que en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, si aún no lo ha hecho, suministre los paquetes mensuales de pañales requeridos por el padre del demandante, durante el tiempo que sea necesario de acuerdo a las prescripciones médicas.
- Segundo. Señalar que a Cajanal le asiste el derecho de reclamar ante el Fosyga por los gastos en los que incurra en el suministro de los pañales requeridos.
- Tercero. INAPLICAR por inconstitucional para el caso concreto, la Resolución 5261 de 1994 expedida por el Ministerio de Salud, "Por la cual se establece el Manual de actividades, intervenciones y procedimientos del POS en el Sistema General de Seguridad Social en salud".
- Cuarto. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
