- Primero. Confirmar parcialmente el fallo proferido por el Juzgado
- Cuarto. Penal del Circuito de Barranquilla, dentro del proceso de la acción de tutela instaurada por Edith Patricia Leguía Morales en representación de su hijo contra Salud Total EPS, y conceder, parcialmente, la protección del derecho fundamental a la salud del hijo de Edith Patricia Leguía Morales.
- Segundo. Ordenar a Salud Total EPS que en el término de cinco (5) días, contados a partir de la notificación de esta sentencia, se tomen las medidas necesarias, si no se ha hecho aún, para que el hijo de Edith Patricia Leguía Morales sea valorado por un médico especialista de Salud Total EPS y decida si el menor requiere o no el examen cariotipo, caso en el cual deberá Salud Total EPS tomar las medidas necesarias para que este sea realizado a la mayor brevedad posible, de acuerdo a lo dispuesto por la jurisprudencia constitucional.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
