Primero. Revocar las sentencias proferidas por el Juzgado Laboral del Circuito de San Gil y el Tribunal Superior de San Gil, y en su lugar conceder la tutela de los derechos a la seguridad social y al minimo vital del senor RODOLFO GUTIERREZ BECERRA.
Segundo. Ordenar al Gerente de la E.S.E. Hospital San Juan de Dios de San Gil que, en el termino de cuarenta y ocho (48) horas contadas a partir de la notificacion de la presente providencia, cancele las mesadas pensionales adeudadas al senor RODOLFO GUTIERREZ BECERRA.
En el evento en que la empresa demandada no disponga de los recursos suficientes para el pago que se ordena, contara con el termino de un mes para culminar las gestiones tendientes a la obtencion de los recursos economicos que le permitan cumplir, antes de que venza dicho plazo, con el pago de las mesadas adeudas.
Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
