- Primero. REVOCAR los fallos proferidos por el Juzgado
- Primero. Civil del Circuito de Santander de Quilichao-Cauca, de cuatro (4) de mayo de dos mil (2000) y del Tribunal Superior de Popayan-Cauca de trece (13) de junio del mismo ano, en el expediente T- 350 563, en cuanto negaron las solicitudes de tutela de los accionantes contra EDGAR MINA PAZ, ORLANDO BANGUERO y RUBIELA AGUDELO CARABALI contra EL ALCALDE, LA SECRETARIA DE HACIENDA Y LA TESORERA DEL MUNICIPIO DE SANTANDER DE QUILICHAO-CAUCA.
- Segundo. CONCEDER la proteccion solicitada por los senores EDGAR MINA PAZ, ORLANDO BANGUERO y RUBIELA AGUDELO CARABALI en la demanda de tutela interpuesta contra EL ALCALDE, LA SECRETARIA DE HACIENDA Y LA TESORERA DEL MUNICIPIO DE SANTANDER DE QUILICHAO-CAUCA.
- Tercero. ORDENAR AL ALCALDE, A LA SECRETARIA DE HACIENDA y A LA TESORERA DEL MUNICIPIO DE SANTANDER DE QUILICHAO-CAUCA, que en el termino maximo de cuarenta y ocho horas (48), contado a partir de la notificacion de la presente providencia, si no lo hubieren hecho ya, procedan a hacer las transferencias que por ley corresponde a la Personeria Municipal de Santander de Quilichao-Cauca a fin cancelar la totalidad de los salarios adeudados a los accionantes EDGAR MINA PAZ, ORLANDO BANGUERO y RUBIELA AGUDELO CARABALI. Si ante el juez de primera instancia, al cual se confia la vigilancia y el control sobre el cumplimiento de este Fallo, EL ALCALDE, LA SECRETARIA DE HACIENDA Y LA TESORERA DEL MUNICIPIO DE SANTANDER DE QUILICHAO-CAUCA acreditaran dificultades de liquidez o de flujo de caja que les impida hacer la correspondiente transferencia, se concede para que inicie -probandolo ante el juez- los tramites presupuestales pertinentes, orientados a la obtencion de los recursos que permitan atender en su integridad las aludidas obligaciones en un termino que no podra exceder de un (1) mes.
- Cuarto. PREVENIR a los entes demandados para que en el futuro eviten incurrir en las omisiones que generaron la instauracion de la presente accion de tutela.
- Quinto. DAR cumplimiento por Secretaria General a lo previsto en el articulo 36 del decreto 2591 de 1991.
