- Primero. REVOCAR las sentencias dictadas por el Juzgado
- Décimo.
- Quinto. Penal del Circuito de Medellín y el Tribunal Superior de la misma ciudad en virtud de la acción de tutela formulada por la docente ROMELIA DE JESÚS VERGARA RIVERA, para en su lugar TUTELAR el derecho fundamental de petición a la accionante.
- Segundo. ORDENAR, en consecuencia, al la Fiduciaria La Previsora S. A. que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta Sentencia, decida acerca de si confiere o no el visto bueno a la solicitud de cesantías parciales para liberación de hipoteca presentada por la educadora ROMELIA DE JESÚS VERGARA RIVERA, sin que supedite el derecho a la disponibilidad presupuestal.
- Tercero. ORDENAR al Fondo Nacional de Prestaciones Sociales del Magisterio, Regional Antioquia, que oportunamente resuelva de manera definitiva, en la forma que legalmente corresponda, la petición formulada por la docente ROMELIA DE JESÚS VERGARA RIVERA sobre cesantías parciales el 12 de noviembre de 1999.
- Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
