- PRIMERO. REVOCAR el fallo proferido por el Juzgado
- Primero. Penal Municipal de Popayán con fecha de 14 de mayo de 2001, que negó la acción de tutela del señor Haimer Fernández Morera.
- SEGUNDO. CONCEDER la tutela que ha dado origen al presente fallo y ORDENAR que en el término de cuarenta y ocho (48) horas se paguen los salarios debidos al señor HAIMER FERNANDEZ MORERA, si es que ello no se ha efectuado.
- TERCERO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
