- Primero. REVOCAR la sentencia proferida por el Juzgado
- Septimo. Civil del Circuito de Bogota, para en su lugar CONCEDER la tutela del derecho a la salud en conexidad con la vida del accionante PEDRO ARTURO CORTES VARGAS.
- Segundo. INAPLICAR, con base en el articulo 4 de la Constitucion Politica y para el caso concreto que fue objeto de examen por esta Sala de Revision, el paragrafo del articulo 28 del decreto 806 de 1998.
- Tercero. ORDENAR al representante legal o a quien haga sus veces, de la E.P.S. COLPATRIA S.A. con sede en Bogota, que dentro del perentorio termino de cuarenta y ocho horas (48) horas a partir de la notificacion de la presente sentencia, autorice la practica de la prueba de laboratorio denominada carga viral dispuesta por el medico tratante del senor PEDRO ARTURO CORTES.
- Cuarto. SENALAR expresamente que a SALUD COLPATRIA, S.A. le asiste el derecho de repetir lo que pague en cumplimiento de este fallo de tutela ante la Subcuenta respectiva del Fondo de Solidaridad y Garantia del Sistema General de Seguridad Social en Salud (FOSYGA).
- Quinto. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
