- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E:
- Primero. CONFIRMAR la decision del 20 de agosto de 1998, proferida por la Sala Laboral del Tribunal Superior del Distrito Judicial de Cali que concedio la tutela interpuesta contra la Seccional Valle del Instituto de los Seguros Sociales, bajo el entendido que la tutela se concede como mecanismo definitivo.
- Segundo. REVOCAR la decision del 10 de septiembre de 1998, proferida por la Sala de Casacion Laboral de la Corte Suprema de Justicia y, por consiguiente, CONFIRMAR la decision proferida por la Sala Laboral del Tribunal Superior del Distrito Judicial de Buga que concedio la accion de tutela instaurada por Ana de Jesus Martinez contra la Seccional del Instituto de los Seguros Sociales en Valle.
- Tercero. Librense por Secretaria las comunicaciones a que se refiere el articulo 36 del Decreto 2591 de 1991.
