- Primero. REVOCAR la sentencia proferida por el Juzgado
- Cuarto. (4) Penal Municipal de Barranquilla el diez (10) de septiembre de 1998 en la acción de tutela instaurada por Neovyluz Zambrano Villamil como agente oficiosa de su madre la señora Inés Mercedes Villamil de Zambrano, contra el Instituto de Seguro Social por violación del derecho a la salud en conexidad con el derecho a la vida.
- Segundo. CONCEDER la protección del derecho a la salud en conexidad con el derecho a la vida de Inés Mercedes Villamil de Zambrano. En consecuencia, se ordena al Instituto de Seguro Social que en el término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, preste el tratamiento médico que ella necesita de acuerdo con la prescripción de su médico tratante.
- Tercero. El Instituto de Seguro Social podrá repetir en contra de la subcuenta de enfermedades catastróficas y ruinosas del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud
- Cuarto. LÍBRENSE por secretaría las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991
