- administrando justicia en nombre del Pueblo y por mandato de la Constitución Nacional,
- RESUELVE:
- Declarar EXEQUIBLES las expresiones "Proponer los retiros por incapacidad profesional", "Emitir concepto sobre la continuidad en la institución de los suboficiales en el grado de Cabo Segundo, que se encuentren en período de prueba", y "Recomendar el retiro o la continuidad en el servicio de los suboficiales sometidos a observación o evaluación eventual por conducta deficiente", contenidas en los numerales 2, 3 y 4 del artículo 55 del Decreto 041 de 1994 "Por el cual se modifican las normas de carrera del personal de oficiales y suboficiales de la Policía Nacional y se dictan otras disposiciones", bajo el entendimiento de que las actuaciones del Comité de Evaluación de Suboficiales deben constar en acta en donde aparezcan los motivos del retiro que se recomienda, dentro de las reglas del debido proceso administrativo.
