Demanda de inconstitucionalidad contra el artículo 148 (parcial) de la ley 100 de 1993.
El demandante sostiene que la expresión “escasos recursos” contenida en la norma acusada, vulnera los artículos 13 y 48 de la Constitución Política.
La Sala concluye que el precepto que contiene las expresiones demandadas no continúa produciendo efectos, toda vez que se presentó una derogación orgánica y tácita en virtud de la expedición de las leyes 181 de 1995 y 797 de 2003.
Igualmente, porque la pensión a la que se hacía alusión en dicha norma fue reglamentada y por ende, nunca se introdujo en el ordenamiento jurídico.
La Corte decide declararse INHIBIDA para emitir un pronunciamiento de fondo, por no existir materia sobre la cual pronunciarse.
