- Primero. Declarar INEXEQUIBLE el literal b) del articulo 184 del Decreto 85 de 1989.
- Segundo. Conforme a los condicionamientos expuestos en el numeral 5.10 de la parte motiva de esta Sentencia, declarar EXEQUIBLE el literal c) del articulo 184 del Decreto 85 de 1989, salvo la expresion "o sean considerados como delincuentes de cualquier genero o antisociales como, drogadictos homosexuales, prostitutas", que se declara INEXEQUIBLE.
- Tercero. Declarar EXEQUIBLE la expresion "o practicar o propiciar la prostitucion" contenida en el literal d) del articulo 184 del Decreto ley 85 de 1989, asi como la expresion "Ejecutar actos de homosexualismo", incluida en el mismo literal, pero bajo el entendido de que se trate de actos sexuales, sean ellos de caracter homosexual o heterosexual, que se realicen de manera publica, o en desarrollo de las actividades del servicio, o dentro de las instalaciones castrenses, propiamente dichas.
