- Primero. Declarar EXEQUIBLES los artículos 77-2 y 130 de la ley 200/95 "por el cual se adopta el Código Disciplinario Unico".
- Segundo. Declarar EXEQUIBLE la expresión "Oportunidad para rendir exposición. Quien tenga conocimiento de la existencia de una investigación disciplinaria en su contra y antes de que se le formulen cargos, podrá solicitar al correspondiente funcionario que le reciba la exposición espontánea", del art. 147 de dicha ley, bajo la condición de que se entienda que la oportunidad para rendir la exposición voluntaria se contrae no sólo a la etapa de la investigación sino de la indagación preliminar.
- Tercero. Declarar INEXEQUIBLE la expresión "aquél la recibirá cuando considere que existen dudas sobre la autoría de la falta que se investiga. En caso contrario negará la solicitud con auto de trámite", del art. 147 de la referida ley.
