Demanda de inconstitucionalidad contra el numeral 1, artículo 15 de la Ley 91 de 1989, “por la cual se crea el Fondo Nacional de Prestaciones Sociales del Magisterio”.
El actor señaló que discriminó a los docentes varones que adquirieron el derecho a pensionarse con 50 años y 20 de servicio al 29 de enero de 1985, por cumplir los requisitos que establece la excepción del parágrafo 2o. del artículo 1o. de la Ley 33 de 1985.
La Sala concluyó que el demandante no formuló contra el mismo texto un cargo de inconstitucionalidad concreto que permita su cotejo con el ordenamiento superior, de manera que se inhibió de pronunciarse sobre los cargos demandados.
