  1. en nombre del pueblo y por mandato de la Constitución,
  2. RESUELVE:
  3. Declarar EXEQUIBLE el artículo 158 del Decreto 624 de 1989 -Estatuto Tributario-, en el entendido de que la deducción aplicable a los gastos por impuesto sobre la renta en inversiones efectuadas en el sector agropecuario en sus coeficientes de amortización, en cuanto toca con desmontes y obras de desecación, solamente podrá ser reconocida por la administración tributaria previa certificación específica del Ministerio del Medio Ambiente o de las corporaciones autónomas regionales en el sentido de que los desmontes y la desecación que se adelanten no perjudican el ambiente ni el desarrollo sostenible de los recursos naturales.
