1) Decláranse INEXEQUIBLES, por ser contrarios a la Constitución Política, los artículos 16, 17 y 18 de la Ley 6a. de 1992.
2) Ordénase al Ministerio de Hacienda y Crédito Público REINTEGRAR, en un término que no podrá ser superior a seis (6) meses contados a partir de la comunicación de esta sentencia, la totalidad de las sumas recaudadas por concepto de la aplicación del artículo 17 de la Ley 6a. de 1992.
3) Ordénase al Ministerio de Hacienda y Crédito Público -Unidad Administrativa Especial Dirección de Impuestos Nacionales- CESAR de manera inmediata todo procedimiento investigativo o sancionatorio iniciado en contra de los contribuyentes que no cancelaron oportunamente el valor de los BDSI.
