- Primero. Declarar EXEQUIBLE el art. 129 del decreto 261/2000, en cuanto no hubo exceso en el ejercicio de las facultades extraordinarias que le fueron otorgadas al Gobierno por el artículo 1, numeral 3 de la ley 573/2000.
- Segundo. Declarar INEXEQUIBLE la expresión "de un cargo de carrera por nombramiento en provisionalidad o", contenida en el inciso 1 del art. 129 del decreto 261/2000 y declarar EXEQUIBLE la expresión igualmente contenida en dicho inciso que dice "Asi mismo, quedará excluido del régimen de carrera el servidor que tome posesión de un cargo de libre nombramiento y remoción".
