- Primero. REVOCAR el fallo proferido por el Juzgado
- Octavo. Civil del Circuito de Bogotá, en cuanto negó la tutela de los derechos fundamentales a la vida y a la salud de Fabian Andrés Rodríguez Nope.
- Segundo. ORDENAR a Cafesalud E.P.S., que en forma inmediata asuma los tratamientos requeridos por Fabian Andrés Rodríguez Nope, a juicio del médico tratante, sin condicionar en modo alguno la prestación de los servicios al pago de suma alguna de dinero.
- Tercero. Cafesalud E.P.S., podrá repetir por el valor que desembolse por concepto de este fallo, en contra de la Subcuenta de Enfermedades Catastróficas o Ruinosas del Fondo de solidaridad y Garantía del Sistema General de Seguridad Social en Salud.
- Cuarto. Líbrense por Secretaria, las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
