- Primero. Revocar la Sentencia proferida por el Juzgado Treinta y Ocho Civil Municipal de Bogota, del trece (13) de junio de 2003 en la que se decidio no tutelar los derechos invocados a favor de Zoraida Romero de Ariza.
- Segundo. Conceder la proteccion del derecho a la salud en conexidad con el derecho fundamental a la vida de Zoraida Romero de Ariza. En consecuencia, ordenar a la Salud Colmena E. P. S. que en el termino de 48 horas siguientes a la notificacion del fallo, ordene la practica de la prueba diagnostica confirmatoria de Hepatitis C recomendada por su medico tratante.
- Tercero. Autorizar a Salud Colmena E.P.S. para que repita contra el FOSYGA por el costo de la prueba diagnostica realizada a la beneficiaria de la tutela de la referencia. El FOSYGA dispondra de quince (15) dias para reconocer lo debido o indicar la fecha maxima dentro de la cual lo hara y, luego, dara cumplimiento a la obligacion reconocida.
- Cuarto. Librese por Secretaria General la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991, ademas de remitir copia de la sentencia a la Superintendencia Nacional de Salud y al Ministerio de la Proteccion Social.
