- Primero. REVOCAR la sentencia de marzo 21 de 2003, proferida por el Juzgado
- Séptimo. Penal Municipal de Bucaramanga que negó la protección solicitada por el señor HOLGUER MARTINEZ GALVIS. En su lugar, TUTELAR el derecho a la salud en conexidad con la vida.
- Segundo. INAPLICAR, con base en el artículo 4 de la Constitución Política, y para el caso concreto que fue objeto de examen por parte de esta Sala, el artículo 18 de la Resolución 5261 de 1994 del Ministerio de Salud, por la cual se establece el Manual de Intervenciones y Procedimientos del Plan Obligatorio de Salud.
- Tercero. ORDENAR a CAFESALUD E.P.S que en el término de 48 horas contadas a partir de la notificación de esta sentencia practique al señor HOLGUER MARTINEZ GALVIS el examen de carga viral para Hepatitis C, prescrita por su médico tratante.
- Cuarto. A CAFESALUD E.P.S., le asiste el derecho de repetir por lo costos en que incurra con ocasión del cumplimiento de este fallo de tutela ante la subcuenta respectiva del Fondo de Seguridad y Garantía del Sistema de Seguridad Social en Salud - FOSYGA -.
- Quinto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
