- Primero. REVOCAR el fallo del Juzgado
- Tercero. Laboral del Circuito de Manizales y en consecuencia, conceder la protección que merecen los derechos a la salud y a la vida de señor Jorge Eliecer Gutierrez Osorio.
- Segundo. INAPLICAR por inconstitucional, para el caso concreto, el artículo 61 del Decreto 806 de 1998, ORDENAR al Seguro Social, Seccional Manizales, que en forma inmediata practique al demandante las intervenciones quirúrgicas necesarias y le prodigue los tratamientos indispensables, a juicio de los médicos de la institución, sin condicionar en modo alguno la prestación de tales servicios al pago de dinero.
- Tercero. El Seguro Social podrá repetir lo que desembolse por concepto de este Fallo, en contra de la Subcuenta de Enfermedades Catastróficas o Ruinosas del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud.
- Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
