Primero. REVOCAR la sentencia proferida por el Juzgado Veinticuatro Civil del Circuito de Bogotá. En consecuencia, conceder el amparo solicitado por el señor Reinaldo Ernesto Tangarife Castillo.
Segundo. INAPLICAR de conformidad con el artículo 4 de la Constitución Política y para este caso específico el parágrafo del artículo 12 de la resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7 del Acuerdo 008 de 1994, del Consejo Nacional de Seguridad Social en Salud.
Tercero. ORDENAR a la E.P.S. del INSTITUTO DE SEGUROS SOCIALES I.S.S., que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a ordenar el efectivo suministro e implantación de los audífonos ordenados por el médico tratante del señor Reinaldo Ernesto Tangarife Castillo.
Cuarto. AUTORIZAR a la E.P.S. INSTITUTO DE SEGUROS SOCIALES I.S.S. a repetir contra el FOSYGA, por la suma de los dineros invertidos en el cumplimiento de la orden emitida en este fallo.
Quinto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
