- Primero. CONFIRMAR la sentencia proferida el 13 de julio de 2000 por el Juez Promiscuo Municipal de Malambo y Revocar la sentencia proferida el 28 de agosto de 2000 por el Juez Promiscuo del Circuito de Soledad.
- Segundo. TUTELAR el derecho a un medio ambiente sano, en conexidad con el derecho a la salud y el derecho a la vida de los actores. En consecuencia, impartir instrucciones al Alcalde Municipal de Malambo para que en un término máximo de 48 horas contadas a partir de la notificación de este fallo y con cumplimiento del principio de legalidad presupuestal, si aún no lo ha hecho, inicie las gestiones necesarias para programar el presupuesto de la próxima vigencia fiscal proyectando los recursos necesarios para efectuar el gasto relacionado con las obras necesarias para el destaponamiento de la tubería del alcantarillado de ese municipio en el sector comprendido entre la calle 5ª entre carrera 4ª y 5ª.
- Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
