- PRIMERO. CONFIRMAR la sentencia del veinte (20) de octubre de mil novecientos noventa y cuatro (1994) proferida por la Sala Penal de la Corte Suprema de Justicia, la cual, a su vez, confirmo, con modificaciones, la sentencia proferida el dos (2) de septiembre de mil novecientos noventa y cuatro (1994) de la Sala Penal del Tribunal Superior de Cartagena.
- SEGUNDO. No obstante la decision confirmatoria que se adopta, la prohibicion de otorgar licencias no comprende la relativa a la construccion de obras que correspondan a la satisfaccion de necesidades publicas y al cumplimiento de objetivos sociales, como serian por ejemplo, la construccion, ampliacion o remodelacion de vivienda social, escuelas o centros educativos, hospitales, edificios para dependencias oficiales, centros para la atencion de la familia, la ninez y las personas de la tercera edad.
- TERCERO. ORDENAR que por la Secretaria General de esta Corporacion, se envien copias de esta sentencia a la Procuraduria Delegada para Asuntos Ambientales, al Ministerio del Medio Ambiente y a la Superintendencia de Servicios Publicos, a efecto de que velen por su exacto cumplimiento.
- CUARTO. ORDENAR que por la Secretaria General de esta Corporacion, se comunique esta providencia a la Sala Penal del Tribunal Superior del Distrito Judicial de Cartagena de Indias, en la forma y para los efectos previstos en el articulo 36 del decreto 2591 de 1991.
