- primero. de la parte resolutiva del fallo del 26 de enero de 2001 del Juzgado
- Quinto. Civil Municipal de Bucaramanga, en el sentido de conceder la tutela de los derechos a la salud y a la vida de la señora Doris María Vacca Padilla.
- Segundo. REVOCAR PARCIALMENTE el fallo del 26 de enero de 2001 del Juzgado
- Quinto. Civil Municipal de Bucaramanga, que ordenó a la E.P.S. Salud Colmena realizar las gestiones necesarias para remitir a la señora Doris María Vacca Padilla a la institución de la red pública pertinente, a fin de que se le practiquen los exámenes que requiera y, si es del caso, sea remitida a una ARS para su atención y tratamiento. En su lugar, ORDENAR a Colmena Salud que, dentro de las cuarenta y ocho horas siguientes a la notificación del presente fallo, autorice, de conformidad con las indicaciones médicas, el suministro del desfibrilador que requiere la señora Vacca y, dado que ya existe la orden para su implantación, se haga dentro de las 48 horas siguientes al suministro del aparato. Esta EPS deberá asumir los costos del tratamiento y podrá repetir por los gastos adicionales en que incurra contra el Fondo de Solidaridad y Garantía, subcuenta de promoción de la salud.
- Tercero. Por Secretaría líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
