- Primero. Revocar la sentencia del 19 de abril de 2004 proferida por la Sala Laboral del Tribunal Superior de Bucaramanga dentro de accion de tutela de Elma Maria Buitrago, en representacion de su marido Gustavo Bohorquez Rojas contra la Secretaria de Salud Departamental de Santander.
- Segundo. Tutelar los derechos a la vida y a la salud de Gustavo Bohorquez Rojas y en consecuencia, ordenar a la Secretaria de Salud Departamental de Santander que adopte las medidas necesarias para que en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de la presente sentencia, garantice a Gustavo Bohorquez Rojas el acceso a los servicios de salud que requiriera para el tratamiento del cancer que le fue diagnosticado, indicando a la IPS correspondiente que se subsidiara el 100% del valor de tales servicios.
- Tercero. Librar por Secretaria General la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991 y remitir copia del presente fallo a la Sala Laboral del Tribunal Superior de Santander.
- Cuarto. Para garantizar la efectividad de la accion de tutela, el Juzgado 2deg Laboral del Circuito de Bucaramanga notificara esta sentencia en el termino de cinco dias, contados a partir del momento en que se haya recibido la comunicacion a la que se hace referencia en el numeral anterior.
