En este asunto pretende el accionante que a través de la acción de tutela se deje sin efecto el acto administrativo mediante el cual el Alcalde de Yumbo aceptó su renuncia al cargo de Gerente del Hospital La Buena Esperanza E.S.E..
Aduce el actor que el mandatario supeditó su nombramiento a la suscripción de una carta de renuncia y que él la firmo porque no quería problemas sino ejercer el cargo para el cual concursó, hasta el vencimiento del período institucional.
Luego del análisis de rigor concluye la Sala que la acción de tutela es IMPROCEDENTE por el incumplimiento del requisito de subsidiariedad.

Penal del Circuito de Cali con funciones de conocimiento del veinte (20) de marzo de dos mil trece (2013), que revoco la sentencia del Juzgado Veinticinco Penal Municipal de Cali con funciones de control de garantias del veinte (20) de febrero de dos mil trece (2013), por las razones expuestas en la presente providencia.
- SEGUNDO. Librese, por Secretaria General, la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
