Primero. REVOCAR la sentencia de la Corte Suprema de Justicia, Sala de Casación Laboral y en su lugar CONCEDER la tutela por violación al derecho de petición del actor. En consecuencia, se ORDENA a la Fiduciaria la Previsora S.A., que si aún no lo ha hecho, proceda en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia a resolver la petición del actor en lo de su competencia, luego de lo cual deberá dar traslado a la Coordinación del Fondo de Prestaciones Sociales del Magisterio del Atlántico para lo de su competencia.
Segundo. ADVERTIR a la Coordinación del Fondo de Prestaciones Sociales del Magisterio del Atlántico para que dentro del término de ley proceda a la resolución definitiva y de fondo de la petición del actor dentro del marco de su competencia, notificándole la decisión correspondiente.
Tercero. Por Secretaría General, COMPULSAR copias de esta sentencia y del expediente respectivo a la Procuraduría General de la Nación, para lo de su competencia y de conformidad con la parte motiva de este proveído.
Cuarto. Por Secretaría General, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
