- Primero. REVOCAR las sentencias proferidas por el Juzgado
- Segundo. Penal Municipal de Barbosa del 13 de mayo de 1997 y del Juzgado Penal del Circuito de Girardota del 20 de junio de 1997. En su lugar CONCEDER la tutela de los derechos fundamentales al medio ambiente sano y a la intimidad de la senora Libia Ines Cadavid Castano.
- Segundo. ORDENAR a los senores Gustavo de Jesus Agudelo Garcia y Luis Fernando Jimenez Osorio para que en el termino de un (1) mes contado a partir de la notificacion de la presente sentencia, procedan a efectuar las correspondientes adecuaciones tecnico-sanitarias pertinentes a fin de solucionar el problema ambiental que se presenta en sus porquerizas. Lo anterior no es obice para que en el mismo termino procedan a solicitar la correspondiente licencia sanitaria senalada en los terminos del articulo 53 del Decreto 2257 de 1986. Para tal efecto y en relacion con todas las otras porquerizas existentes dentro del perimetro urbano del municipio de Barbosa, el Secretario de Medio Ambiente de dicha localidad debera proceder de acuerdo con lo senalado por el decreto antes citado, todo esto con la unica finalidad de proteger la salubridad publica.
- Tercero. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
